At a Glance (Copyright Governance)

Poetry in Urdu (accessible at https://poetryinurdu.online) respects the intellectual property rights of authors, translators, estates, and publishers. We maintain a clear dual framework: classical works by deceased masters reside in the public domain, while modern poetry is presented strictly under statutory fair dealing / fair use for literary criticism. Our original English translations, Roman Urdu adaptations, and Tashreeh remain our proprietary works.

🏛️ Public Domain: Life + 50 years verified
📚 Fair Dealing: Sec 57 educational review
✍️ Proprietary: Translations & Tashreeh
⚡ DMCA Response: Within 24–72 hours

1. Commitment to Authorial & Statutory Rights

Poetry in Urdu operates with unwavering respect for intellectual property, copyright statutes, and the timeless dignity of literary authors. Our publishing standards comply with:

  • The Pakistan Copyright Ordinance, 1962 (as amended by Copyright Amendment Act 2000).
  • The Berne Convention for the Protection of Literary and Artistic Works.
  • The Universal Copyright Convention (UCC).
  • The Digital Millennium Copyright Act of 1998 (DMCA, 17 U.S.C. § 512).
  • The Indian Copyright Act, 1957 (Section 52 - Fair Dealing provisions).

2. Classical Urdu Poetry in the Public Domain

Under Section 18 of the Pakistan Copyright Ordinance 1962, statutory copyright in a literary work subsists during the lifetime of the author and expires 50 years following the calendar year of the author's death (the Life + 50 term).

Verified Public Domain Classical Masters:

All original poetic texts authored by masters whose death occurred more than 50 years ago reside squarely in the global public domain. This includes, without limitation:

Mir Taqi Mir (1723–1810)
Khwaja Mir Dard (1721–1785)
Mirza Asadullah Khan Ghalib (1797–1869)
Hakim Momin Khan Momin (1800–1852)
Sheikh Ibrahim Zauq (1789–1854)
Nawab Mirza Khan Dagh Dehlvi (1831–1905)
Mir Anees (1803–1874)
Mirza Salamat Ali Dabeer (1803–1875)
Allama Muhammad Iqbal (1877–1938)

Works by these historical poets are free of copyright restrictions and belong to the common cultural heritage of humanity. We present their verses with faithful attribution.

3. Modern & Contemporary Poetry (Fair Dealing / Fair Use)

For 20th and 21st-century poets whose works remain within statutory copyright protection, poems and selected couplets are published under recognized statutory exceptions:

Fair Dealing under Pakistani Law: Under Section 57(1)(a) & (b) of the Pakistan Copyright Ordinance 1962, fair dealing with any work for the purpose of research, private study, criticism, or review does not constitute an infringement of copyright.

Fair Use under U.S. Law: In accordance with 17 U.S.C. § 107, reproduction of copyrighted works for purposes such as criticism, comment, scholarship, or research is recognized as fair use.

Fair Dealing under Indian Law: Section 52(1)(a) of the Indian Copyright Act 1957 similarly protects fair dealing for criticism, review, and reporting.

Our presentation of modern poetry is strictly transformative and educational: we pair selected verses with original linguistic commentary, Roman Urdu transliterations, and thematic categorization to assist students and international readers. We do not sell copies of whole copyrighted books or substitute for commercial editions.

4. Proprietary Original Works of Poetry in Urdu

While classical verses themselves belong to the public domain, the distinctive creative expressions crafted by Poetry in Urdu are original proprietary works protected under global copyright law:

  • Roman Urdu Transliteration Systems: Curated phonetic representations designed for non-Urdu script readers.
